1.3 Orderly Group LTD is referred to in these Terms & Conditions as “Prizesino”, “the Promoter”, “we”, “us” or “our”.
1.4 These Terms govern competitions, prize draws, instant win promotions and other prize promotions made available through the Prizesino website.
1.5 Contact details for customer support are provided in section 28 below and on our Contact Us page.
Application of These Terms
2.1 By entering a Prizesino competition, you agree to be bound by:
- (a) these Terms & Conditions;
- (b) the information and specific conditions displayed on the relevant competition page;
- (c) our Privacy Policy; and
- (d) any additional rules expressly identified as applying to that competition before you enter.
2.2 Each individual competition page may contain competition-specific information including:
- (a) the prize;
- (b) the entry price;
- (c) the maximum number of entries available;
- (d) any maximum entries permitted per person;
- (e) the opening date;
- (f) the closing date and time;
- (g) the draw date or expected draw date;
- (h) the qualifying question;
- (i) whether a cash alternative is available;
- (j) any instant win prizes; and
- (k) any prize-specific eligibility, collection or delivery conditions.
2.3 Where competition-specific terms conflict with these general Terms, the competition-specific terms will apply to that competition to the extent of the conflict.
2.4 You should read these Terms and the relevant competition page before entering.
Eligibility
3.1 Unless a competition page expressly states otherwise, entrants must:
- (a) be aged 18 years or over at the time of entry;
- (b) be legally resident in the United Kingdom;
- (c) provide accurate and complete entry information; and
- (d) comply with these Terms.
3.2 We may request reasonable evidence of age, identity and UK residency before awarding a prize.
3.3 Employees, officers and directors of Orderly Group LTD and members of their immediate household may not enter Prizesino competitions.
3.4 Anyone directly involved in administering, operating, auditing or determining the outcome of a particular competition may not enter that competition.
3.5 Entries made using false identities, fraudulent information or on behalf of another person without authority may be rejected.
3.6 It is the entrant’s responsibility to ensure that they are legally permitted to enter and, where relevant, legally capable of owning, registering, insuring or receiving the prize.
How Competitions Work
4.1 Prizesino makes prizes available through competitions advertised on the website.
4.2 Unless otherwise stated on the relevant competition page, eligible entrants may participate either:
- (a) by purchasing an online entry; or
- (b) by using the Free Postal Entry route described in section 6.
4.3 Valid paid and valid free postal entries participate in the same applicable draw.
4.4 The method used to select the eventual winner will not distinguish between a valid entry because it was obtained through the paid online route or the free postal route.
4.5 Competition-specific details will be clearly displayed on the relevant competition page before entry.
4.6 No entrant is guaranteed to win merely by entering or by purchasing a particular number of entries.
Paid Online Entry
5.1 To enter through the paid online route, entrants must follow the instructions on the applicable competition page.
5.2 The price of an entry will be clearly displayed before purchase.
5.3 Where ticket bundles, discounts or promotional pricing are available, the applicable price and number of entries will be shown before payment.
5.4 Entrants must provide any information reasonably required to process the entry.
5.5 An online entry is not valid until:
- (a) the required entry process has been completed;
- (b) any qualifying question has been answered correctly where applicable;
- (c) payment has been successfully authorised and received; and
- (d) the entry has been recorded by our system.
5.6 Following successful entry, the entrant will normally receive confirmation through their Prizesino account and/or by email.
5.7 Entry numbers or ticket numbers allocated to paid entries do not provide any greater chance per entry than entry numbers allocated through the Free Postal Entry route.
Free Postal Entry
6.1 A Free Postal Entry route is available for eligible competitions.
6.2 No payment to Prizesino is required to enter using this route. Entrants remain responsible for the ordinary cost of first or second class postage.
6.3 Details of the Free Postal Entry route are available through the clearly accessible “Free Postal Entry” page on the Prizesino website.
6.4 To submit a free postal entry, an entrant must send an unenclosed postcard by first or second class post containing clearly legible:
- (a) full name;
- (b) date of birth;
- (c) full postal address;
- (d) email address;
- (e) contact telephone number;
- (f) the exact name of the competition being entered; and
- (g) the entrant’s answer to the qualifying question applicable to that competition.
6.5 Free postal entries must be sent to:
Free Postal EntriesPrizesino
Orderly Group LTD
20 Wenlock Road
London
N1 7GU
United Kingdom
6.6 One postcard constitutes one entry into one named competition unless expressly stated otherwise.
6.7 Where multiple postal entries are permitted, each entry must be submitted separately in accordance with the instructions displayed on the Free Postal Entry page.
6.8 Postal entries must be received by us before the closing date and closing time of the relevant competition. The date of posting is not the date of receipt.
6.9 Entrants should allow sufficient time for postal delivery.
6.10 We are not responsible for postal entries that are lost, delayed, damaged or otherwise not received, where that failure is outside our reasonable control.
6.11 Proof of posting does not constitute proof that an entry has been received.
6.12 A valid postal entry received before the closing deadline will be allocated an entry number and included in the applicable competition.
6.13 Valid free postal entries and valid paid entries are treated equally when determining the winner.
6.14 The mechanism used to select the winning entry does not distinguish between paid and free entries.
6.15 The Free Postal Entry route will remain available for eligible competitions in accordance with the instructions displayed on the website.
Qualifying Questions
7.1 Where a competition requires entrants to answer a qualifying question, the question will be displayed on the relevant competition page.
7.2 Both paid entrants and free postal entrants must provide the required answer.
7.3 An entry containing an incorrect, missing or invalid answer will not constitute a valid entry.
7.4 The correct answer will be determined by Prizesino using reasonable and objectively supportable information.
7.5 Where there is genuine ambiguity concerning an answer, Prizesino may obtain independent advice before determining whether an entry is valid.
7.6 Nothing in these Terms should be interpreted as a representation that a qualifying question by itself determines the regulatory status of a competition.
Entry Numbers and Entry Limits
8.1 Each valid entry will be allocated a unique entry or ticket number where the competition uses numbered entries.
8.2 Entry numbers have equal standing in the draw regardless of whether the entry was obtained through the paid or free route.
8.3 The maximum number of entries available for a competition will be displayed on its competition page where applicable.
8.4 Any limit on entries per person will also be displayed before entry.
8.5 Entrants must not attempt to circumvent entry limits through:
- (a) multiple accounts;
- (b) false identities;
- (c) third parties;
- (d) automated systems; or
- (e) any other method intended to evade an entry restriction.
8.6 Entries exceeding a clearly stated per-person limit may be cancelled or disqualified.
Competition Closing Dates
9.1 Each competition will display its closing date and, where appropriate, closing time.
9.2 Entries received after the applicable deadline will not be included.
9.3 Prizesino will not extend a closing date merely for the purpose of obtaining additional paid entries.
9.4 A closing date will only be changed where exceptional circumstances outside our reasonable control make this necessary and where changing the date is lawful and fair to entrants.
9.5 Where a material change is necessary, affected entrants will be informed where reasonably practicable and appropriate information will be published on the website.
9.6 Where Prizesino advertises a competition as a guaranteed draw, the draw will not be conditional upon a particular percentage or number of paid tickets being sold, subject only to exceptional circumstances addressed elsewhere in these Terms.
Draws and Winner Selection
10.1 Once a competition has closed, a winner will be selected from all valid entries accepted into that competition.
10.2 Winners of random prize draws will be selected in accordance with the laws of chance.
10.3 Winner selection will use either:
- (a) a computer process capable of producing verifiably random results; or
- (b) another random selection process conducted by, or under the supervision of, an independent person.
10.4 Prizesino will retain appropriate records demonstrating how a winner was selected.
10.5 Every valid entry included in a particular draw will have the same chance of being selected as every other individual valid entry in that draw.
10.6 Holding multiple valid entries will result in an entrant having multiple individual entries in the draw, subject to any applicable entry limit.
10.7 Unless otherwise stated, only valid entries submitted before the closing deadline will participate.
10.8 Draw results may be announced through the Prizesino website, social media channels, live broadcasts or other communication channels.
Instant Win Competitions
11.1 Certain Prizesino competitions may include Instant Win prizes.
11.2 Where Instant Win prizes are available, the relevant competition page will state:
- (a) that Instant Wins are available;
- (b) the nature and number of Instant Win prizes;
- (c) any applicable claim conditions; and
- (d) any relevant closing date.
11.3 Instant Win allocations are generated or allocated using a fair and random process.
11.4 The system used for Instant Wins is designed to be capable of appropriate independent verification.
11.5 A participant who wins an Instant Win prize will be informed as soon as reasonably practicable through the website/account interface or other specified method.
11.6 Prizesino will not advertise an Instant Win prize as available if it has not genuinely been made available in accordance with the stated mechanism.
Prizes
12.1 The prize for each competition will be described on its competition page.
12.2 Images may be used for presentation purposes but the description of the prize will identify its material characteristics.
12.3 Where a prize is a vehicle, the competition page should identify relevant details where available, including:
- (a) make and model;
- (b) approximate specification;
- (c) whether the vehicle is new or used;
- (d) mileage if relevant;
- (e) significant options or modifications; and
- (f) whether any cash alternative is offered.
12.4 Unless expressly stated otherwise, ongoing costs associated with a prize after transfer to a winner are the responsibility of the winner. For a vehicle this may include:
- (a) insurance;
- (b) fuel;
- (c) maintenance;
- (d) servicing;
- (e) parking; and
- (f) subsequent taxes or charges.
12.5 Prizes are non-transferable before award unless Prizesino expressly agrees otherwise.
12.6 Prizes will not be withheld merely because a competition generated fewer paid entries than expected.
12.7 Prizes will only be withheld where an entrant has failed to meet qualifying criteria clearly stated in the applicable rules or where another lawful basis exists.
Winner Notification and Verification
13.1 Winners will be contacted using the information supplied when entering.
13.2 Prizesino may contact a winner by:
- (a) telephone;
- (b) email;
- (c) their Prizesino account; and/or
- (d) another contact method supplied by the entrant.
13.3 We will make reasonable efforts to contact a winner.
13.4 A potential winner may be required to provide reasonable evidence of:
- (a) identity;
- (b) age;
- (c) UK residency;
- (d) eligibility;
- (e) ownership/control of the relevant entrant account; and
- (f) compliance with these Terms.
13.5 A winner will not be disqualified merely because they cannot be contacted immediately.
13.6 Where, after reasonable attempts over a reasonable period, a winner cannot be contacted or fails to provide required eligibility information, Prizesino may treat the prize as unclaimed and select an alternative winner where permitted.
13.7 Where an entrant is disqualified, Prizesino will retain an internal record of the reason.
Prize Delivery and Collection
14.1 Prizes will normally be delivered, transferred or made available for collection within 30 days of the winner being confirmed unless:
- (a) the relevant competition page specifies another period; or
- (b) circumstances outside our reasonable control make this impossible.
14.2 Where delivery is required, Prizesino will agree reasonable arrangements with the winner.
14.3 Vehicle winners may be required to provide information needed to complete lawful vehicle transfer and registration.
14.4 The winner is responsible for arranging appropriate insurance before driving any vehicle prize.
14.5 A vehicle will not be released to a winner who intends to drive it away unless any legally required insurance, licence or other requirements have been satisfied.
Publication of Winners
15.1 Prizesino may publish or make available information demonstrating that a valid award has taken place.
15.2 For major prizes this will ordinarily consist of the winner’s surname and county, together with details of the prize won.
15.3 Entrants will be informed before or at entry that this information may be published or made available.
15.4 A winner may object to publication or request that the amount of information published about them be reduced.
15.5 We will consider such requests in accordance with applicable data protection requirements.
15.6 Where required to demonstrate compliance to the Advertising Standards Authority or another competent authority, we may provide appropriate winner information notwithstanding a public objection where legally permitted.
Cash Alternatives
16.1 A cash alternative will only be available where the relevant competition page expressly states that one is offered.
16.2 Where a cash alternative is offered, the amount or basis on which it is calculated will be stated before entry.
16.3 A winner cannot require Prizesino to provide a cash alternative where none was advertised.
16.4 Prizesino will not replace an advertised prize with a materially lower-value substitute merely because insufficient paid entries were sold.
16.5 Where events outside our reasonable control make the exact advertised prize genuinely unavailable, any proposed substitute will be handled fairly and in accordance with applicable law and advertising rules.
Refunds, Cancellations and Failed Payments
17.1 Except where required by law or expressly provided by these Terms, valid paid competition entries that have been successfully processed and entered into a competition are not ordinarily refundable.
17.2 Nothing in these Terms limits any statutory rights a consumer may have.
17.3 Where Prizesino takes payment but is unable to provide the purchased entries due to an error attributable to us, the affected entrant will receive either:
- (a) the entries purchased; or
- (b) an appropriate refund.
17.4 An entry associated with a failed, reversed, fraudulent or subsequently charged-back payment may be cancelled where payment has not ultimately been received.
17.5 If Prizesino cancels a competition without awarding the advertised prize, paid entrants will ordinarily receive a refund of the relevant entry payments unless another remedy has been lawfully agreed.
17.6 Refunds will normally be returned to the original payment method where practicable.
Competition Changes or Cancellation
18.1 Prizesino will administer competitions fairly and in accordance with the terms presented to entrants.
18.2 We will avoid changing material competition terms after entries have been accepted.
18.3 Material terms, including closing dates and prizes, will only be changed in exceptional circumstances where necessary.
18.4 We will not change the prize, closing date or entry mechanism merely because sales are lower than anticipated.
18.5 Where a competition cannot reasonably proceed due to circumstances outside our control, we may cancel it.
18.6 If a paid competition is cancelled without a winner being awarded the advertised prize, affected paid entries will ordinarily be refunded.
18.7 Nothing in this section permits Prizesino to make a change that would unfairly disadvantage entrants or breach applicable law.
Prohibited Conduct
19.1 Entrants must not:
- (a) use bots, scripts or automated entry systems;
- (b) manipulate the website or entry process;
- (c) exploit technical vulnerabilities;
- (d) provide false identity information;
- (e) create multiple accounts to evade entry restrictions;
- (f) interfere with another entrant;
- (g) fraudulently reverse payments;
- (h) attempt to manipulate a draw;
- (i) tamper with Instant Win systems; or
- (j) engage in activity intended to obtain an unfair advantage.
19.2 We may suspend accounts or investigate entries where there are reasonable grounds to suspect fraud or abuse.
19.3 Entries will not be disqualified arbitrarily.
19.4 Where an entrant is disqualified, there must be a reasonable basis connected to these Terms or applicable law.
Website and Technical Problems
20.1 We will take reasonable steps to keep the Prizesino website and competition systems operational.
20.2 We do not guarantee that the website will be completely uninterrupted or error-free.
20.3 If a technical error materially affects the integrity or fairness of a competition, we will take reasonable steps to investigate and remedy the issue fairly.
20.4 An entrant should contact customer support promptly if payment has been taken but entries have not appeared in their account.
20.5 Nothing in this section allows Prizesino to avoid responsibility for matters for which liability cannot lawfully be excluded.
Intellectual Property
21.1 The Prizesino name, logo, website design, software, graphics and original website content are owned by or licensed to Orderly Group LTD.
21.2 No person may reproduce or commercially exploit Prizesino intellectual property without permission except where permitted by law.
21.3 Entry into a competition does not transfer ownership of Prizesino intellectual property to an entrant.
Personal Data and Privacy
22.1 Personal information collected through competitions will be processed in accordance with the Prizesino Privacy Policy and applicable UK data protection law.
22.2 We may process information for purposes including:
- (a) administering entries;
- (b) processing payments;
- (c) preventing fraud;
- (d) contacting winners;
- (e) verifying eligibility;
- (f) delivering prizes;
- (g) complying with legal obligations; and
- (h) customer support.
22.3 Marketing communications will be handled in accordance with applicable consent and electronic marketing requirements.
22.4 Entrants should review the Privacy Policy for further information about how personal data is collected, retained and shared.
Publicity
23.1 We may invite winners to participate in reasonable promotional activity such as photographs, videos, interviews or winner stories.
23.2 Participation in additional promotional activity will not be compulsory unless this was clearly and lawfully disclosed as a condition before entry.
23.3 Where separate consent is required for particular uses of personal data or imagery, such consent will be obtained appropriately.
23.4 Refusing optional publicity will not result in a winner losing a prize to which they are otherwise entitled.
Our Liability
24.1 Nothing in these Terms excludes or limits liability where it would be unlawful to do so.
24.2 In particular, nothing excludes or limits liability for:
- (a) death or personal injury caused by our negligence;
- (b) fraud or fraudulent misrepresentation; or
- (c) any other liability that cannot lawfully be excluded.
24.3 Nothing in these Terms affects an entrant’s statutory consumer rights.
24.4 Subject to the above, Prizesino will not be responsible for loss caused by events outside our reasonable control where such exclusion is lawful.
Complaints
25.1 We aim to administer all competitions fairly and transparently.
25.2 Entrants who have a complaint should contact Prizesino customer support using the contact information in section 28.
25.3 The complaint should include:
- (a) the entrant’s name;
- (b) relevant competition;
- (c) relevant order or entry information where applicable; and
- (d) an explanation of the complaint.
25.4 We will investigate complaints and aim to provide a substantive response within a reasonable period.
25.5 This complaints procedure does not prevent a consumer from exercising any legal rights available to them.
General
26.1 If any provision of these Terms is determined to be unlawful or unenforceable, the remaining provisions will continue in effect.
26.2 A failure by Prizesino to enforce a provision immediately does not necessarily constitute a waiver of that provision.
26.3 We may update these general Terms from time to time.
26.4 Changes to these general Terms will apply prospectively and will not retrospectively alter material conditions of an existing competition where doing so would unfairly disadvantage entrants.
26.5 The version applicable to an entry will generally be the version in effect when that entry was submitted, together with the competition-specific terms applicable at that time.
26.6 Nothing in these Terms creates a partnership, employment relationship or agency relationship between Prizesino and an entrant.
Governing Law
27.1 These Terms are governed by the laws of England and Wales.
27.2 If you live in another part of the United Kingdom, you may also benefit from mandatory consumer protections and rights to bring proceedings in the courts applicable to your place of residence.
27.3 Nothing in these Terms removes any mandatory legal rights available to consumers.
